Project StarForge Web™ Design Terms of Service

All services provided by Project StarForge Web™ (PSF Web) are subject to the following terms and conditions.

=Hours of Operation - Section 1=
(A) PSF Web‘s business hours are listed here for our clients connivance. During our hours of operation any modifications, maintenance, or other services will be at our normal rate of $45.00 US. (B) After our posted hours including weekends or holidays an additional charge of $30 per hour on top of our normal hourly rate will be charged for any after hour assistance.

=Quotes & Contracts - Section 2=
(A) Quotes provided to prospect clients will be honored for 30 days. A new quote will then be provided upon request. (B) Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request. (C) All Quotes and Contracts are always for the items, designs, and services listed in them. Any additional modifications (including but not limited to: Special spacing, Additional features, Additional code changes, Or additional graphical changes for any reason) will be taken care of after the contract is fulfilled. And will be done and charged as additional work to a “Finished” website.

= Development & Delivery Turnaround Time - Section 3=
(A)Here at PSF Wed we understand the importance of completing projects in a timely manner. That is why we offer two forums of prioritized development timetables (1) Normal Priority, (2) Urgent Priority

(1)Our Normal Priority – We offer a “Guaranteed 60 Day Turnaround” from the date of contract signing for Normal Priority clients. An initial concept is developed and sent to the client in 7-14 calendar days

(2)Our Urgent Priority – (+50% “Rush” charge applied) We offer a “Guaranteed 45 Day Turnaround” from the date of contract signing for Urgent Priority clients. And will have the initial design concept in 5 working days.

(B)We are able to do this given the client supply's PSF Web with required text, graphic content, and other requested materials for the contracted project within 30 days of contract signing. (C) If the client does not supply PSF Web with the required items in 30 days the contract becomes void and all deposits paid by the client are forfeited. (D) The client may request a Project Extension in writing to PSF Wed for an additional fee of 25% of the project total cost for every 30 days of extension. All extension fees are due upon agreement of the extension between PSF Wed and the client.

=Charges & Fees - Section 4=
(A) PSF Web has broken our charges into three categories to propagate easy and affordable payment for a given project.

(1) For projects $400.00 US or less requires full payment upon contract signing.

(2) Projects between $400.01 and $900.00 US will be split into two payments. 50% deposit of the total project cost will be due at contract signing. The remaining 50% balance will be due upon acceptance of the completed web development project before it is released to the client or published to the internet.

(3) Any projects that exceed $900 US will be split into three payments. An initial deposit of 1/3 of the total project cost will be due at contract signing. A second payment of 1/3 the total project cost will be due upon acceptance of the design. The final balance will be due upon acceptance of the completed web development project before it is released to the client or published to the internet.

(B) Any check payments that do not clear will be charged a $40.00 fee. (C) PSF Web retains the right to hold all graphics, and project development with the exception of content and graphics provided by the client, until payment is received for such items. (See copyright & ownership clause - Section 9)

=Payments - Section 5=
(A) Project StarForge Web accepts the following payments types via;
-Visa
-PayPal
-Cash
-Checks
-Money Orders
No other payment types will be accepted at this time.

(B) We can provide a payment plan to our clients to allow them to get their webpage up and running if they do not currently have the needed money. (1) Depending upon the state of business PSF Web reserves the right to stop or start providing new payment plans at its own will. (2) Application and rates can be provided as a quote per client basis for each project. We like to work with our clients for the best plan that suits their needs. (3) However if the contract is broken said webpage will immediately taken down, and a notification of service termination put in its place. (4) The webpage will then become the property of PSF Web again. And we will encourage our client to work out a new payment plan so that they can get their webpage back up and running.

(C) Any given project will not be released to a client or uploaded until full payment is received or a payment contract is signed.

=Refunds - Section 6=
(A) PSF Web requires a deposit before we begin work on any project. (B) A request to terminate services must be presented to PSF Wed in writing. (C) PSF Wed has a Guaranteed 60 Day Turnaround for a client’s project. (1) If we fail to complete your project within 60 days of the start date AND (2) you have turned in all content, images and information requested by us before the 55th day, you will receive a full refund within 30 days of your written request. Otherwise, please follow the refund terms below.

(D) Refund Amounts will be calculated in the following ways:
1. A cancellation fee of 20% (twenty percent) of the total deposit paid will be retained for projects that have been booked, but cancelled prior to the start date.
2. A cancellation fee of 30% (thirty percent) of the total deposit paid will be retained for projects that have been started and are in the design process.
3. A design fee of $250 (two-hundred and fifty dollars) will be retained on projects where the design portion of the development has been completed, and the client has accepted the design, but whereas the development process of the project has not begun. (Upon payment, the design will be released to the client for use, see copyright & ownership clause)
4. Projects that are in the development process at the time the request for termination is received will be billed at the hourly rate of $45 per hour. Should the amount of time put into your project be greater than the deposit you have paid to PSF Wed, you will be billed the difference. Upon payment of these fees, the work completed up to the time of termination will be released to the client.

(E) Refunds will be processed within 30 business days of request by the client, if there is a refund amount due based on the terms above. Refund will be presented in form of mailed check or money order.

(F) Because we resell hosting for a larger company, (1) we are unable to offer refunds on hosting, SSL and domain services. (2) If you are dissatisfied with the hosting services provided, we will be happy to work out a solution with you that will meet your company needs.

=Web Site Design Credit - Section 7=
(A) All PSF Web clients will have a ‘Design by: PSF Web’ link on their website in the footer of every page. (1) This is non-negotiable. (2) By hiring us to work on your website you are agreeing to this, and that you understand that this link may NOT be removed without our consent. (3) You may pay PSF Web a fee of $250 to have this link permanently removed. (4) If you should have a new layout designed for your site by a company other than PSF Web, and the changes to the site are more then 50.1% (See Third-Party Changes clause) you may remove the credit from your website. Thank you.

=Advertisements - Section 8=
(A) PSF Web can set up advertisements for your business through Google AdWord to be advertised on other sites to pull in additional customers. (1) However because this is a third party service, advertisements are subject to Google’s terms and conditions also (2) it is not the responsibility of PSF Web for payment for this service. (B) Any site PSF Web produces can have advertisements added to it (1) for the cost of adding the advertisement code into the webpage and any redesigning that needs to be done. (2) This will come at the cost of $45 per hour of work to add said code. (3) The cost to add ad code can be discounted when this code is provided to be entered while the site is being created. (C) Otherwise all web sites PSF Web produces participate in the Google AdSense program, displaying Google’s advertisements on the sites we create. (1) Because of this service PSF Web is able to make cheap and affordable sites to our customers. (2) By hiring us to work on your website you are agreeing to this, and that you understand that this code may NOT be removed without our consent. (3) The number of ads on a page will never exceed three per page. (4) The exact number of ads that will be displayed on a certain number of pages will be negotiated before signing of contract for the creation of a site. (5) Google AdSense code may not be removed from the site unless the site is changed more then 50.1% by a Third-Party, no exceptions. (6) Google AdSense code can be removed by PSF Web after the course of a full year (plus a business quarter) upon request by client. (7) PSF Web will remove the code permanently for the cost of code removal (at $45 per hour) (8) plus the annual revenue that the code produced for said past year. (9) All advertisements will be blended into the site and will not stand out. (10) If there are any issues with this PSF Web will fix the code to help is blend in more for free.

=Copyright & Ownership - Section 9=
(A) Upon completion of the project, (1) PSF Web transfers all rights and ownership of any “CUSTOM” designs and programming written by PSF Web to the client. (2) Any pre-designed software/graphics and/or third party graphics or programs are not transferred to the client and (3) remain under copyright of their respective owners.
(B) Any and all graphics and logos that are entered into the webpage on request by the client, (1) including company names, logos, trade marks, or artists work, is the sole responsibility of the client to gain permission of, written or otherwise, to use on the site. (2) Upon legal action against client any misused materials will be taken down without charge (3) however any modifications or fixing of the site will be chargeable.

(C) PSF Web reserves the right to resell custom designed web sites that remain unpaid by the original client, unaccepted mockups or other graphics created by PSF Web but not in legal use by the client.

(D) PSF Web reserves the right to (1) display websites and graphics that have been designed by PSF Web on their website, (2) and in any marketing material to aid as examples of our work.

=Chargeback’s=
(A) PSF Web will not negotiate chargeback’s with any person or company. (B) Our Refund policies are clearly stated above, and (1) all clients are asked to read and agree to our terms of service prior to the start of any project.

=Non-Communication - Section 10=
(A) If we are unable to communicate with a client on a project (1) for a duration of at least thirty days (30) by phone or email or other communication methods during the design and development process, (2) the project will be canceled without prior notice and no refund will be issued. (B) All PSF Web’s Contact information can be seen here or here. (1) Please make sure PSF Web has up-to-date contact information.

=Liability - Section 11=
(A) Services purchased from (1) PSF Web are provided "as is" without warranty of any kind that the web design project will be (2) uninterrupted or error free. (3) In no event shall PSF Web be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services, and/or goods provided to the client. (4) This includes, without limitation to, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client.(5) The entire risk as to the quality and performance of the web design is with the client.

=Our Guarantee’s - Section 12=
(A) PSF Web is able to provide our “Guaranteed 60 & 45 Day Turnaround” for CSS/HTML projects only at this time. (1) Any projects that require the implantation of Flash, PHP, or Java script or any additional coding for the entire site is not covered in this capacity. (B) If the 60 or 45 Day Guarantee is not met on qualifying sites one of two options can be taken by our client. (1) A written request of termination can be submitted and all payment will be returned as stated in ‘Section 6’. Or (2) Client can receive a 50% discount for the finished product (excluding service fee’s) (3) if another 45 days pass the project can be discounted for 75% or refunded still. (4) If a case ever went past another 45 days the project can be bought for a 99% discount off the project cost. (C) PSF Web currently has no other guarantees and will only honor guarantees that are not listed here.

=International Customers - Section 13=
(A) PSF Web is happy to accept projects from customers outside of the United States. (B) However, we do require full payment of all projects prior to beginning your project via Credit Card or PayPal. This is non-negotiable.

=Project Consideration - Section 14=
(A) Please note that PSF Web is a family owned and operated company. (1) Therefore, we have the right not accept projects that we find morally questionable, unethical, or distasteful. (2) However this will be discussed on a ‘Project to Project Basis’.

(B) Notice: This Agreement shall be governed by and construed in accordance with the laws of the State of California. Exclusive jurisdiction and venue is as governed in the district court of San Diego County, in San Diego, California.

=Acceptance - Section 15=
(A) Please note that by submitting your down payment for our services you are agreeing to all of our terms of service as written here. (B) PSF Web reserves the right to change or update these terms at any time without prior notice. (1) Upon request any changes that are made to the ToS can be sent to a given E-Mail whenever updated.
